What Is Fair Use Copyright Law?

June 4th, 2008 by junmisaki332

Many people are interested in the Fair Use copyright law. The Fair Use copyright law enables people to use portions of material that is copyrighted for the purposes of criticism or as commentary. The hard part for many people is understanding what is permissible under the Fair Use copyright law and what is not permissible. Anyone who writes or publishes should brush up on what is allowed and what is not allowed. Using another person’s words to make news reports, to use as a comment or criticism or to use for research, scholarship, or for educational uses that are nonprofit are generally considered Fair Use. In these instances, the Fair Use copyright law allows one person or author to make use of another person or author’s work without asking permission to do so. In situations that do not fall within these specifications, you are probably violating someone’s copyright if you use their work - especially if you are using another person’s work for economic or commercial gain.

When you are trying to see if you can use another’s words, you should keep a few things in mind. The answer to the following questions will help you gage whether you would be violating a copyright.

First, are you transforming someone else’s work or are you copying it?

Second, are you making any financial gains from your work that would compete with the original copyright holder?

Third, do you have the author’s permission to quote their work? Just because you list the author and give credit to him or her does not protect you from infringing upon someone’s copyright.

Fourth, how much of the original author’s work are you using? If you are using a substantial amount of another’s work, you are probably in direct violation of their copyright.

Many publishing companies have set rules on how much material they will allow to be quoted in other sources. Some of these ranges start at 100 words or less. However, there are truly no standards to go by, so be careful. You can not assume that keeping your copying fewer than 50 words will allow you to pass under the radar - especially if the original piece is hovering around 125 words itself!

Lastly, what portion of another’s work are you using? If it is the meat of the book and the most important part of the book, you are probably in direct violation of the owner’s copyright.

With a little common sense it is not hard to decide if you are violating someone’s copyright. People who are truly interested in staying within the guidelines of the Fair Use copyright law usually do a good job of doing so. Many people push the Fair Use copyright law right up to the line, while others will blatantly cross over it without giving a second thought to the repercussions. When these people are summoned to court to answer for their vagrant disregard for the property and copyright of another, they are usually sorry. Sorry they got caught! It is very important that people who take advantage of the Fair Use copyright law are held accountable for their actions. Without accountability many more people would follow in their footsteps and use other creators’ works as their own.

Why eMarketing Matters

June 3rd, 2008 by junmisaki332

The Internet has long since passed the buzzword stage of business adaptation. It is now recognized as an integral part of any new successful business venture. While the Internet’s business value has become ubiquitous in industry journals and classroom texts, very few businesses truly understand why successful eMarketing, and not simply a Web presence, may be the true path to Internet business nirvana.

“If you build it, they will come” only works in the movies

In this respect doing business on the Internet is no different than its brick and mortar counter-part. It’s not the old-school business 101 mantra of “location, location, location”, but rather the new-school mantra of “visibility, visibility, visibility.” Of the billions of pages existing in the Internet’s ethereal online universe only 16% are indexed by search engines (source: Web Developer’s Journal). This is in high contrast to the 73% of customers who use search engines to find new Web sites (source: Jupiter Media). If your potential customers can’t locate your site it becomes that much more difficult for them to purchase your services or goods.

However, search engines aren’t the only way to drive traffic to your site. A successful eMarketing approach will be integrated to drive traffic through multiple channels. Press releases can drive interested consumers from online news placements, white papers will help turn researchers into purchasers, online advertising (banner ad’s, newsletter sponsorships, etc.) can entice prospective clients from other sites to browse your wares as well, viral marketing and Web-based guerrilla marketing campaigns can bring tremendous brand awareness and drive results, but are a notoriously finicky audience. Businesses with established customer relationships, especially in the b2c realm, can repeatedly tap their existing client base to drive new traffic and increase sales through active e-mail engagements that entice customer’s to make impulse purchases multiple times throughout the year.

Businesses can also effectively use offline ad campaigns to drive new visitors to your site. This is inherently a bit more difficult as you are requiring customers to remember your Web site address, which is not always easy. The most effective offline campaigns are integrated with online campaigns to take a comprehensive approach to customer engagement. A targeted direct mailing with personalized e-mail and telephone follow-ups that drive clients to a Web-based demo of services will ultimately attain much better results than the more limited traditional mail-only approach.

In short there is more to eMarketing than a Web site presence and an integrated eMarketing approach is the only way to ensure that your business reaches the widest possible target audience and successfully achieves online nirvana.

The Simpsons (Season 8) DVD Review

June 2nd, 2008 by junmisaki332

One of the best TV shows of the modern era, or for that matter any era, The Simpsons rekindled the popularity of the prime time animation genre. A blockbuster series filled with a diverse cast of characters from the fictional town Springfield, the series aided the upstart FOX network in its rise from second-rate TV channel to the elite status of a major network like CBS, NBC, or ABC. This overwhelming success opened the door for a number of similar animated series such as Futurama (1999), The Family Guy (1999), and King Of The Hill (1997). With arguably of the best collection of writing talent in the TV industry, The Simpsons has managed to maintain consistency as one of the funniest shows on television - quite an accomplishment given the length of its run.

The Simpsons (Season 8) DVD features a number of hilarious episodes including the season premiere “Treehouse of Horror VII,” one of the best of the annual Simpson Halloween episodes. The three stories covered include the discovery of Bart’s evil twin in the attic, Lisa’s creation of an alternative universe, and an alien invasion propagated by Bob Dole and Bill Clinton look-alikes. Other notable episodes from Season 8 include “A Milhouse Divided” in which Milhouse’s parents decide to get a divorce, prompting Homer and Marge to take sides in the separation, and “The Itchy & Scratchy & Poochie Show” in which Homer becomes the voiceover for the highly anticipated arrival of Poochie, a new character on the Itchy & Scratchy Show. The Beaches Of Goa

June 2nd, 2008 by junmisaki332

There is a belief that Goa is one long beach, whereas the reality is that Goa has seven rivers, so what with that and the towns and roads, Goa is in reality several beaches on its 125 km coastline.

The beaches in fact cover 83km of the coastline, and almost wherever you go, you can choose your water sports, shop, eat remarkable food, and drink exotic cocktails and beers, all at an amazingly cheap price.

Somewhere there is a beach for you, just waiting on you to arrive and explore, and your options are summarized below:

The Aguada Bay is between two promontories the Cabo and Aguada. Parts of the bay are known as Caranzalem and Sinquerim Bay. Here you will find 40 lovely beaches, nearly all are very clean and unpolluted, but not necessarily safe for swimming. The most torist would be the Calanguta, Baga, Anjuna strip in The Bardesh subdivision which is north of Panaji.

Go north for the untouched unspoiled beaches, these are found in the Pernem subdivision and the names to watch for are Keri Beach, Arambol[Harmal], Mandrem which has two little beaches Lemos and Asvem, and Morji. Up here you won’t get so much hassle, although the accommodation tends to be in thatched huts.

The previously discussed Bardesh subdivision is bordered by the Chapora River, and this is where you will find the following beaches. The Chapora, Anjuna, Baga, Calangute, Candolim, Sinquerim and an inner rocky beach called Quegdevelim, which is worth visiting for shell collecting.

The Tiswadi subdivision off the Mandovi estuary there are small tranquil beaches here worth trying.

Other beaches worth mentioning are Caranzalem, marvel, Dona Paula, Bambolim and Siridao, they are close to Mormuga harbour and the Mormugao sub division where you will find truly excellent beaches with names like Bogmalo, Cola, Issorcim, Pale, Velsao, and Cansaulim. Seafood is particularly good in this area, but be warned the Vasco da Gama beaches of Cumberthi and Baina are very polluted.

You will find in the Salcete subdivision Goa’s widest and cleanest and widest beaches, so look out for names like Gaudalim, Colva, Benaulim, Mobor, Varca, Carmona, and Cavelossim, although it is now the home to far too many new hotels.

If you travel further south you will find more primitive beaches again, probably most suited to young adventurers, who don’t mind camping. They are in the sub division of Canacona, which is where Goa ends, and here you will find the Palolem, Colamba, Talpona, and Galgibaga beaches.

There are so many beaches Goa you can’t possibly visit them all, but you can give it your best shot.

The Simpsons (Season 4) DVD Review

June 1st, 2008 by junmisaki332

Originally a spin-off from a one-minute segment of The Tracy Ullman Show, The Simpsons morphed into the then-burgeoning FOX network’s most successful program. As the longest running animated television show in history, and the longest running prime-time show of any type, The Simpsons is an American treasure - a combination of humor, wit, and satire that examines not just the lives of its eccentric characters, but also the society, culture, and world in which we live. Fun for adults and children alike, The Simpsons is a cutting edge television comedy that, like Seinfeld, changed the television landscape in the 1990’s by creating a new genre of TV fun that spawned large network investments in new animated series such as King of the Hill, Futurama, and The Family Guy.

Like all new things which smash the paradigm of life, The Simpsons is unrivaled by its knockoffs, and the show doesn’t show signs of slowing down. If you haven’t yet visited Springfield, then I definitely recommend that you pick up The Simpsons DVD (Season 1) to catch a glimpse for yourself. You have no idea what you’ve been missing…

The Simpsons Season 4 DVD offers a number of hilarious episodes including the season premiere “Kamp Krusty” in which Bart forges his report card so that Homer and Marge will allow him to go to Kamp Krusty, a traditional summer camp for America’s youth. But the summer camp is anything but traditional, and the kids soon learn as they’re forced to make cheap wallets and perform other acts usually reserved for Third World foreign laborers. The kids endure until it’s revealed that Krusty will not be visiting as promised, the news of which prompts Bart to spark an uprising… Other notable episodes from Season 4 include “Itchy & Scratchy: The Movie” in which Bart’s punishment (that he can not see the new Itchy & Scratchy movie) threatens to drive him to the brink of insanity, and “Duffless” in which Homer’s arrest for a DWI forces him to submit to a campaign of anti-drinking films and AA meetings (made all the worse by Marge’s request that he quit drinking for one month)…

Below is a list of episodes included on The Simpsons Season 4 DVD:

Episode 60 (Kamp Krusty) Air Date: 09-24-1992
Episode 61 (A Streetcar Named Marge) Air Date: 10-01-1992
Episode 62 (Homer the Heretic) Air Date: 10-08-1992

PPC Advertising: Where Do You Start?

May 31st, 2008 by junmisaki332

PPC Advertising could be the most fast & effective methods of online promotion, once you understand how to follow its strategy, targeted traffic are driven to your website.

PPC Advertising in simple matters is promoting your website in terms of paid listings in search engines.

What you need to create your PPC Campaign?

Proper bid management for potential keywords increases ad exposure anytime someone uses a related search term, this increase click through rate (CTR) from prospect leads.

Conduction of market research is a crucial step to start your PPC Advertising strategy with; defining your target markets will help you select your keywords. Emphasize on niche keywords that are not so competitive for lower bidding cost, especially if you have your budget determined.

In PPC Advertising creating an attractive sales copy containing relevant keyword phrases in title & description is challenging. Therefore learning the techniques is worth all the time before starting with the campaign.

PPC Ad copy style needs to be simple & straight, especially the title as it is most significant for visitor’s observance, adjust the keywords in order to comply with what you offer to earn credibility. Make sure your ad points to the appropriate landing page, the last thing you want is to mislead your website visitors & have them hunt for the information they are searching, a turnoff like that means losing money.

Calculating your conversion rate is important to do in order to measure the campaign success for a certain period of time. This is done by dividing number of visitors by number of sales, and then by dividing net profit per sale by conversion rate you will know your precise value of CTR as cost per click should not exceed it or else loss occurs.

For example, for every 100 visitors from your PPC ad, you expect 1 sale. You spend 15 $ on click ads to spread over the 100 visitors the 15 cents should be the bidding CPC to breakeven.

Analyzing & monitoring of visitor behavior will help you understand their interests & habits; this will make it easier to select your keywords for better PPC management. Make sure you don’t fall for click fraud attempts, examples of this are:

-Multiple clicks from a single IP address.
-Large amount of clicks at a specific period of time
-Clicks from countries where no business is conducted

Conclusion

Once you strategize your PPC advertising campaign, determine the maximum CPC you are willing pay for specific keyword phrase. According to your ad conversion rate, profit margins as well as other factors value of CPC could change at certain times.

Information For Cattle Breeders - Ultrasound, The Way To Go

May 30th, 2008 by junmisaki332

This year we decided to try ultrasound on some of the bulls in bull test. Most other breeds such as the Hereford, Angus, Shorthorn and Charlois have been using ultra sound for up to 5 years. We have always considered Murray Greys to be the best at marbling and passing along those genetics but other than our numerous carcass wins at various carcass competitions, we had no other source of carcass grading. When talking to the ultra sound technicians as well as some of the herford breeders there were several things that were impressed upon us.

1. The results are relative.

2. The results are genetic in that certain families will have higher marbling than others.

3. Heifers should be done at about 1 year of age. Age should be kept constant as it affects results and ones with low results can be culled from the herd.

4. Relative EPD’s can be extrapolated from the results but must be done from the states. This involves some extra costs and the animal must have a strip shaved in it’s side.

The accuracy of the ultrasound depends upon the technician doing the readings. Our results were done by Rod Wendorff and Doug Ralph both certified technicians. The accuracy is high enough that bulls selected based on ultrasound results will result in a positive genetic change in progeny carcass traits. Heritability for carcass traits are moderate to high, being slightly higher than birth weights, weaning weights, and yearling weights.

It is a well know fact that marbling is the best indicator of just how tasty the beef will be. Research shows that meat AAA and above produces the most satisfied consumers. As marbling increases so does the juiciness, flavor and the tenderness, so why not use all means available to better production from the ranch.

So to understand the ultra sound results.

Marbling
3.00 - 3.99…………..Single A……………..Standard
4.00 - 4.99…………..Double AA…………..Select
Above 5.00………….Triple AAA…………..Choice

Remember that the age of the animal should be taken into consideration. A high AA that will be fed for an additional 90-100 days will likely result in a AAA carcass. Keeping in mind that some genetics may never reach AAA.

Back Fat MM

The fat measurement gives an indication of the bulls fleshing ability. Fat bulls have less lean meat/muscle in the carcass. Calves from a bull with very little fat may finish too slowly. Bulls with excessive fat may suffer reduced fertility. Back fat is also related to a female’s ability to produce milk, rebreed, reach early puberty and maintain a short calving interval.

Rib Eye Area (REA IN2)

The Rib Eye is the largest muscle in the body at birth so the REA gives an indication of overall carcass muscling. This is measured in inches. Big is good but read on…..

Adjusted REA IN2/100 lbs

The largest rib eye area may belong to the largest bull. Adjusting the REA to 100 lbs body weight helps determine which bulls are more muscular and which bulls are simply heavier.

Cutability (%LMY)

Cutability is the percentage lean meat yield in the carcass. Back fat will reduce yield by 7 to 8 times what REA will increase the yield.

So to sum it all up.

• It is desirable to have an animal that has high marbling, large rib eye and high percentage lean meat yield.

• Remember that moderation and balance are key ingredients of a successful breeding program.

• Knowing what cow families produce the best marbling will only increase your yield and herd performance.

Suzan Moore, with partner, Ed Gilmet began raising Murray Grey cattle in 2000. We did extensive research to determine which breed to invest in and chose the Murray Greys for their low key maintenance, easy calving and ability to marble naturally on grass pasture. http://www.gilmoranch.ca.

SEO 101 For Beginners Revised

May 29th, 2008 by junmisaki332

Did you know that you can dramatically increase the number of visitors that come to your site on a daily basis from Google?

Web Content (Mass + Keywords) + Links = SEO

Image Text or Javascript?

Question: Navigation is based on images, again if these are images of text?

Answer: Search engines obtain links very considerable and only read text. they like to match the topic of the target page to the text in the link that pointed to the page. Avoid Javascript.

what to do: Use text only navigation. the text and containing elements can by styles with CSS to set up them look like images, give a background image, or at least rearrange them look a little fancier. The optional is to ensure that there is some text based navigation elsewhere on the page.

Gains: Search engines will be able to match the topic of the target page with the reputation (link text). A higher relevancy is better. Ensuring there is text on the page will also help the visually impaired who use text only browsers in conjunction with braile output devices or text to speach software.

Links, and Link Relevancy

Question: You want lots of links to your website?

Answer: Although links may be great for visitors and search engine spiders, the true appraise of the link may not be fully clear to you. Visitors are unlikely to click on irrelevant links and search engines hate them. Reciprocal links (you link to me, and I’ll link to you) can be of use when associated, but carry less weight in the search engines than one way inbound links.

what to do: Avoid link farms (pages of links, for the sake of links), treat reciprocal link requests with anticipation and stay associated.

Gains: Spending time and thought on your link profile will ensure natural growth of links. Search engines hate anything that looks artificial, or anything that could be interpreted as ‘Search engine Trick’.

Duplicate Content

Question: A webmaster copies content from another website, or sets up numerous sites which are identical, or very similar. Is this mechanism works?

Answer: search engines apply echo content filters to the search results. Although the idea of increasing the market share is a bona fide idea, thousand similar sites is not the way to go about doing it. Efforts put into the secondary sites will be forfeited.

what to do: endorse all of the pages on each of your sites are unique. Querying a search engine for an exact match of long strings of text will show you if the content is bring up elsewhere. If a webmaster does have facsimile pages and wishes to avoid any penalties or filters, the webmaster must choose one page to have the other identical pages redirect to. Redirects are covered later. You may also use random RSS Feeds that are mixed before show up on each page. The RSS have the ability that are always have fresh content but only if you mix 3 or more RSS feeds you will get a unique result and not what all the other sites have that are using the same RSS feeds.

Gains: Your efforts are not wasted, time and money can be saved. Always Fresh content from the RSS Feeds.

Numerous Sites

Question: Following on from identical content, there are numerous sites. A single webmaster has a certain number closely themed sites, all inter-linked and hosted on the same IP address.

Answer: This is seen as search engine Frame-up, the linking structure and numerous sites just isn’t natural. Penalties can apply.

what to do: Such site structures can work if set out properly. this means that each site must reside on it’s own IP address where, at least, the C class is different. IP address are covered later.

Gains: Increased market share, effectively linked and spiderable sites, no penalties applied.

Unfriendly URLs

Question: The URL (web address) of some of your sites pages look like domain dot com/product.php?id=2346&category=665&sid=f29a3483270cc10b3783706916216e3a

Answer: Search engine spiders are getting better and following and indexing these form of URLs, bit not all of them. The spiders are scared of getting caught in an endless loop of identical pages with 1000s of different URLs. they are also off putting to your site visitors who could surely remember mydomain dot com/products/cars/boostvalves.

what to do: Use Search Engine Friendly URLs. If you are running the Apache webserver on Linux enabled server use mod_rewrite to translate the URLs into something nicer

Gains: Higher chance of being indexed by more of the search engines, keywords in your URL, higher chance of being clicked on in the SERPs

Redirects

There are two main redirects, based on the HTTP specification

301 - moved permanenty

302 - moved temporarily

You should use 301 redirects where ever possible. this can be done in your server side scripting, eg

Code: php

header(”HTTP/1.1 301 Found”);

header(”Location: w w w newdomain dot com/”);

redirects can also be set up in your .htaccess file, if you run the Apache web server

IP addresses (C class)

IP addresses are the numerical addresses of computers connected tot he internet. For ease of reading they are broken down into four parts, each called an octet as they contain 8 bits of data when written in binary form. An example my be 62.85.68.114. in this case the C class is 68 (and everything up to it), so if you have a few sites hosted on this IP they would all have identical IP addresses. If each had a single IP address that started 62.85.68. then they all share the same C-class IP address. As the allocation of IP addresses within a server involvement is usually configured so that each server has it’s own C-class; this means that a search engine knows hat all sites on the same C-class IP address are all located on the same server

Your competitors might not be standing still; neither should you.

Detroit Schools Has A Difficult Start To The 2006-2007 School Year

May 28th, 2008 by junmisaki332

Detroit Schools’ Teachers Delay School Starts with Strike

There has been a slow and turbulent start to the Detroit Schools ‘ new school year. In a battle over contracts, some 7,000 teachers and 2,000 staff members refused to start school in September. These contract disagreements lead finally to a court battle. The contract disagreement began on August 28 after the Teachers Union rejected a two year contract that included salary cuts of 5% and increased health insurance co-payments. Detroit Schools wants an $88 million concession from the Detroit Schools’ Teachers’ Union to help with the $105 million deficit to its $1.36 billion budget.

On September 16, Detroit Circuit Court Judge Susan Borman ordered that the 7,000 striking Detroit Schools’ teachers return to work. After this order, Detroit Teachers’ Union president Janna Garrison read the order aloud to 3,000 Detroit Federation of Teachers members but did not comment or give any instructions as to whether the order should be obeyed. The vast majority of the teachers did not return to work.

Detroit Schools’ spokesman Lekan Oguntoyinbo stated that under state law teachers who defied the order could face penalties which include fines and other actions. Oguntoyinbo said that Detroit Schools would go back to the courts and request that the order be enforce. As of the 18th of September, teachers had not returned and Detroit Schools has not decided what action it would take.

On the official first day of school, the 130,000 students in the Detroit Schools were greeted by their teachers not in the classroom but protesting outside. The picketing teachers were most of the teachers, only about 9% of Detroit Schools had returned to work. The Detroit Schools Board of Education worried that the strike would cause students to pull out of the Detroit schools and that their families will leave the city, however most parents support the teachers.

Detroit Schools’ Teachers Return to Work

Even though the contract issues have not been fully resolved but the Teachers’ Union has announced that the teachers returned to work on September 20. This was mainly due to pressures from the court and not due to reconciliation between the Detroit Schools and the teachers.

Many Union members, parents and other supporters of the teachers do not want the issue to remain tabled. These supporters want the Detroit Schools system revised. They claim the administration is top heavy and each position should be justified in some way. Others want the Detroit Schools to consider the consolidation of schools. This idea has fewer supporters because it would involve school closures that would greatly affect parents and neighborhoods. Even though this would be the most drastic of the possible ways to change the Detroit Schools, it may be the most cost effective. Like all issues there are many sides. Some wish the Detroit Schools top be run more like a business, which would include offering teacher buyouts, others believe education should be the main focus no matter what the costs.
